Please read these Terms & Conditions carefully. By accessing, enrolling in, or using any services provided by Bitesize Digital School CIC, a registered charity and company limited by shares (Company number 16204338) (referred to as “Bitesize Digital School,” “we,” “us,” or “our”), you and, where applicable, the student’s parent or legal guardian (referred to collectively as “you” or “your”) agree to be bound by these Terms & Conditions and any additional guidelines, policies, or amendments incorporated by reference. If you do not agree with any part of these Terms, you must not use our services.

 

1. Introduction to Bitesize Digital School
Bitesize Digital School CIC is a social enterprise dedicated to providing high-quality digital training programmes designed to empower students aged 10 and above with practical, in-demand, and job-ready skills. We offer a range of digital training streams focused on building proficiency for the modern digital and AI-driven world.

 

2. Definitions
To ensure clarity, the following terms shall have the meanings set forth below:

  • “Services”: Refers to all educational programmes, courses, online platforms, resources, content, support services, and any other offerings provided by Bitesize Digital School CIC.
  • “User” / “You” / “Your”: Refers to any individual accessing or using our Services, including prospective, current, and former students, and where applicable, their parent(s) or legal guardian(s).
  • “Student”: Refers to the individual enrolled in or participating in Bitesize Digital School CIC’s educational programmes.
  • “Parent” / “Guardian”: Refers to the parent(s) or legal guardian(s) of a student who is a minor.
  • “Content”: Refers to all materials, including but not limited to course materials, videos, lectures, exercises, assessments, text, images, audio, software, code, and any other intellectual property made available through the Services.
  • “Platform”: Refers to our website, Learning Management System (LMS), video conferencing tools (e.g., Zoom, Google Classroom), and any other digital infrastructure used to deliver our Services.

3. Eligibility and Parental Consent
Our Services are designed for students primarily aged 10 and above.

  • Minors: If a student is under the age of 18, they may only access and use our Services with the consent and supervision of a Parent or Guardian. By enrolling a minor, the Parent/Guardian explicitly confirms they are the legal parent or guardian, consent to the minor’s participation, and agree to be bound by these Terms & Conditions on behalf of the minor.
  • Parent/Guardian Responsibility: Parents/Guardians are solely responsible for supervising their child’s use of the Services, ensuring their child’s compliance with these Terms, and managing all communications and financial obligations related to the child’s enrolment.

4. Account Registration and Security
To access our Services, you may be required to create an account.

  • Accurate Information: You agree to provide accurate, complete, and up-to-date information during the account registration process and to promptly update any changes to your information.
  • Account Credentials: You are solely responsible for maintaining the confidentiality and security of your account login credentials (username and password). You must notify us immediately at admin@bitesizedigital.school if you suspect any unauthorised access to or use of your account.
  • Account Usage: Your account is personal to you (and your child, if you are a Parent/Guardian). You must not share your account details or allow others to use your account. Bitesize Digital School CIC is not liable for any loss or damage arising from your failure to maintain account security.

5. Access and Use of Services
Access to our Services is granted to registered users only, provided all terms and conditions are met.

  • Lawful and Personal Use: You agree to use our Services solely for lawful, personal, educational, or professional development purposes as intended.
  • Technical Requirements: You are responsible for maintaining your own device, reliable internet connection, and any necessary software to access and effectively use our online Services. We are not responsible for technical issues arising from your equipment or internet service.
  • Service Availability: We strive to ensure continuous availability of our Services. However, we do not guarantee uninterrupted or error-free access. We may suspend, withdraw, or restrict the availability of all or any part of our Service for business and operational reasons (e.g., maintenance, security updates) without prior notice.

6. Prohibited Activities and Online Conduct
You agree not to engage in any of the following prohibited activities:

  • Unauthorised Sharing of Resources: You must not share, distribute, display, record, or transmit any proprietary Content, course materials, meeting links, login credentials, recorded sessions, or any other resources provided exclusively for Bitesize Digital School students or staff, with any third party without our express prior written consent.
  • Unlawful or Harmful Activity: Engaging in any activity that is unlawful, harmful, fraudulent, or violates any applicable local, national, or international law or regulation.
  • Content Misuse: Uploading, distributing, transmitting, or posting any Content that is unlawful, harmful, threatening, abusive, defamatory, obscene, harassing, discriminatory, or otherwise objectionable.
  • Harassment or Abuse: Using our Services to harass, abuse, stalk, threaten, or harm any other person (including other students, tutors, or staff).
  • Unauthorised Access: Attempting to gain unauthorised access to any part of our Platform, other user accounts, computer systems, or networks connected to our Services through hacking, password mining, or any other means.
  • Interference with Services: Introducing viruses, worms, Trojan horses, or other malicious or technologically harmful material, or otherwise attempting to interfere with the proper working of our Services.
  • Impersonation: Impersonating any person or entity, or falsely stating or otherwise misrepresenting your affiliation with a person or entity.
  • Commercial Use: Using the Services or any Content for commercial purposes without our express written permission.
  • Automated Use: Using any robot, spider, scraper, or other automated means to access the Services for any purpose without our express written permission.
  • Circumventing Security: Attempting to circumvent any security features of the Services or the Platform.

Any breach of this Section 6 is considered a serious violation of these Terms and may result in immediate suspension or termination of your access to Services, with no refund of fees.

 

7. Content Ownership and Usage Rights
Ownership: All Content provided through the Services, including but not limited to course materials, videos, images, text, software, and intellectual property, is owned by Bitesize Digital School CIC or our content licensors and is protected by copyright, trademark, and other intellectual property laws.

  • Limited License: You are granted a limited, non-transferable, non-sublicensable, and non-exclusive license to access and use the Content solely for your personal, non-commercial, educational purposes during your active enrolment period.
  • Restrictions: You may not modify, reproduce, distribute, display, perform, publish, license, create derivative works from, transfer, or sell any Content obtained from the Services without our prior express written permission.
  • Student Projects: While students retain intellectual property rights to their individual creative works developed as part of the curriculum, Bitesize Digital School CIC reserves the right to showcase student projects for promotional, educational, or portfolio purposes, provided consent is obtained from the Parent/Guardian in line with our Admissions Policy.
  • Client and Group Projects: For client and group projects, where students collaborate to create a shared output, the intellectual property rights to the collective work developed will be retained by Bitesize Digital School CIC. This allows us to utilise, develop, or showcase these collaborative solutions for educational, promotional, or client-based purposes, benefiting the entire school community and demonstrating our collective capabilities.

8. Fees, Payments, and Cancellations
All matters relating to fees, payments, financial difficulties, bursaries, non-refundable fees, deferrals, and withdrawal from courses are governed by our separate Admission Policy. You agree to adhere to all terms outlined therein, including payment schedules and withdrawal notification requirements.

 

9. Termination and Suspension
We may terminate or suspend your access to our Services, with immediate effect and without prior notice, at our sole discretion, if:

  • You breach any of these Terms & Conditions (especially Section 6, Prohibited Activities).
  • Your conduct is disruptive, abusive, or harmful to other users, staff, or the integrity of our Services.
  • You fail to make timely payments as per our Admission Policy.
  • We are required to do so by law or a regulatory authority.

Upon termination or suspension, you will immediately lose access to your account and any associated Content or Services. No fees will be refunded in the event of termination or suspension due to a breach of these Terms.

 

10. Disclaimer of Warranties
The Services are provided on an “as is” and “as available” basis, without any warranties of any kind, either express or implied. Bitesize Digital School CIC does not warrant that:

  • The Services will be uninterrupted, error-free, secure, or available at any particular time or location.
  • Any defects or errors will be corrected.
  • The Services are free of viruses or other harmful components.
  • The results of using the Services will meet your requirements or expectations.

We disclaim all warranties, including but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

 

11. Limitation of Liability
To the maximum extent permitted by applicable law, Bitesize Digital School CIC, its directors, employees, partners, agents, or affiliates shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of, or inability to access or use, the Services.
  • Any conduct or content of any third party on the Services.
  • Any content obtained from the Services.
  • Unauthorised access, use, or alteration of your transmissions or content.

In no event shall our total liability to you for all damages, losses, and causes of action (whether in contract, tort, or otherwise) exceed the amount you paid for the Services, if any, during the twelve (12) month period immediately preceding the claim.

 

12. Indemnification
You agree to defend, indemnify, and hold harmless Bitesize Digital School CIC and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney’s fees), resulting from or arising out of a) your use and access of the Services, by you or any person using your account and password; b) a breach of these Terms; or c) Content posted on the Service.

 

13. Privacy Policy & Safeguarding
Your use of our Services is also governed by our Privacy Policy, which outlines how we collect, use, and protect your personal information, including details on data retention, your rights, and international data transfers. Please review our Privacy Policy for more details.

 

Additionally, our commitment to the safety and well-being of all students is detailed in our Safeguarding Policy. All users are expected to be aware of and comply with the principles outlined in this policy.

 

14. Governing Law and Dispute Resolution

  • Governing Law: These Terms & Conditions shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.
  • Dispute Resolution: Any dispute, controversy, or claim arising out of or relating to these Terms shall first be attempted to be resolved through good faith negotiation and mediation. If the matter cannot be resolved through such methods within a reasonable timeframe, the dispute will be subject to the exclusive jurisdiction of the courts of England and Wales.

15. Amendments to the Terms
We may update or modify these Terms & Conditions from time to time to reflect changes in our Services, operational practices, or legal requirements. When significant changes are made, we will post the updated Terms on this page, and the “Last Updated” date at the top of the policy will be revised. We may also notify you via email or a prominent notice on our Platform. By continuing to access or use our Services after any such revisions become effective, you agree to be bound by the revised Terms.

 

16. Miscellaneous Legal Provisions

  • Entire Agreement: These Terms & Conditions, together with our Admission Policy, Privacy Policy, and Safeguarding Policy, constitute the entire agreement between you and Bitesize Digital School CIC regarding the use of our Services.
  • Severability: If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
  • Waiver: No waiver of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or any other term or condition, and any failure of Bitesize Digital School CIC to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
  • Force Majeure: Bitesize Digital School CIC shall not be liable for any delay or failure in performance of its obligations under these Terms caused by events beyond its reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labour, or materials.
  • Feedback: Any feedback, comments, or suggestions you may provide regarding the Services is entirely voluntary, and we will be free to use such feedback, comments, or suggestions as we see fit and without any obligation to you.
